Terms of Service

Please read these terms carefully before using our platform.

1. Acceptance of Terms

By registering a restaurant account, subscribing to our plans, or accessing the Res-tau-rent platform (including POS interfaces, booking portals, and waiter request handlers), you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of a restaurant company, you represent that you have the authority to bind such entity.

2. Subscription Plans, Billing & Upgrades

We offer subscription-based access to our SaaS platform under monthly, annual, or lifetime plans:

  • Billing & Renewals: Monthly and annual subscriptions are billed in advance on a recurring basis. Lifetime plans grant lifetime platform usage without ongoing renewal fees, subject to active service terms.
  • Upgrades & Downgrades: Restaurant users can upgrade their subscription package at any time. Pricing will be prorated automatically. Downgrades take effect at the start of the next billing cycle.
  • Refunds: Payments are non-refundable except where explicitly required by local consumer laws. Free trials are provided so users can fully test platform capabilities before subscribing.

3. Service Availability, SLA & Uptime

We strive to maintain a premium and continuous service for restaurant operations:

  • Target SLA: We target a 99.9% uptime rate for order receiving, table management, and POS endpoints.
  • Maintenance: Periodic updates and system backups are scheduled during off-peak hours (between 02:00 and 04:00 UTC) whenever possible. Notices for planned maintenance are posted in the admin dashboard.

4. Use License & Restrictions

We grant you a non-transferable, non-exclusive license to use the Res-tau-rent platform to manage your restaurant operations. You agree NOT to:

  • Modify, duplicate, or reverse-engineer the core POS source code, layout frameworks, or script bundles.
  • Use the platform to process unauthorized card details, conduct fraudulent activities, or store malicious payloads.
  • Bypass tenant restrictions or access other restaurants' order files or configuration paths.

5. Limitation of Liability

In no event shall Res-tau-rent POS or its parent company be liable for any indirect, incidental, or consequential damages (including loss of business profits, restaurant sales disruption, or data loss) arising out of the use or inability to use the platform. Our total liability shall not exceed the subscription fees paid by you in the three (3) months preceding the claim.

6. Dispute Resolution & Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal, India.
